At MayHawk, we value invention. Our methods, processes, packaging, design, names, and visual language are the product of original work and disciplined craft. They define us, reflect our commitment to what we stand for, and set us apart.
Everything we create at MayHawk is deliberate. It reflects our deep commitment to creating beautiful chocolate with care and attention to every detail. From our innovative chocolate-making methods and processes, to our design language, and from our artwork and packaging to our distinctive naming, these are all protected as MayHawk Intellectual Property (IP). This includes our trademarks, copyrights, design rights, trade dress, domain names, and, where appropriate, patents and trade secrets.
MayHawk is known for turning stunning natural ingredients into something beautiful and original. To do this we focus our craft on simplicity, on disciplined product lines, researching new methods and processes, and creating distinctive artwork and designs. These are valuable assets. Any unauthorised use, imitation, or misrepresentation will be treated as infringement. This page, together with our Terms of Use, sets out how we protect them.

Trademarks and trade dress. A trademark may be a word, name, artwork, pattern, sound, phrase, colour, symbol, or design that identifies the source of goods or services. Trade dress is the overall appearance of a product or its packaging — the size, shape, colours, textures, graphics, and even the layout of a store or website. Together, trademarks and trade dress help consumers recognise and distinguish MayHawk from others. Copying or imitating MayHawk packaging — even with differences in brand name — is likely to cause confusion and will be treated as infringement or passing off.
Infringement. Unauthorised use of a MayHawk trademark, service mark, or trade dress is infringement. Only MayHawk, and those we specifically authorise, may use our trademarks, trade dress, logo, artwork, and symbols in connection with products, services, advertising, promotion, or sales. Authorised resellers and licensees must follow their signed agreements and our guidelines exactly. Any other use is not permitted.
Copyright and Trademark Protections. To avoid any misunderstanding: copyright and trademark protections apply automatically in all of our key markets.
In the UK, copyright protects original works from the moment they are created — no registration is required. The same principle applies in the EU, where protection arises as soon as a work exists. In the US, copyright also attaches as soon as a work is created and released publicly, even without a notice or registration.
Trademarks work in a similar way. In all three regions, rights are established through use: once a name, brand identity, or other mark is used in connection with goods or services, the owner acquires enforceable rights. The copyrights, trademarks, and registered service marks of MayHawk are expressed below in a non-exhaustive list.
MayHawk recognises the principle of Fair Use, but also the limits of what it allows. Any use of our intellectual property that goes beyond those limits will be treated as infringement. These protections are recognised internationally, as most countries uphold reciprocal agreements to honour copyright and trademark rights.
Record of first use
MayHawk keeps contemporaneous records of all new developments, and we maintain secure archives of artwork, packaging, methods, and naming. These records provide admissible evidence of priority, authorship, and goodwill, and we will rely on them where enforcement is required.
For each innovation we create — whether a new design, process, or name — we maintain:
- Design documentation: dated design sheets, dielines, sketches, working files, and final artwork.
- Process documentation: written records and research notes on new methods and techniques.
- Naming records: clear evidence of first use of new descriptors, slogans, and product names.
- Publication and use evidence: dated packaging samples, product launches, photographs of products on sale, social posts, press mentions, and invoices or purchase orders.
- Digital proofs: time-stamped website captures, published pages saved as PDFs, and third-party web archive links.
- File integrity checks: hash values (SHA-256) of key files to verify authenticity over time.
This ensures that every step — from concept to first public release — is preserved and verifiable.
What our IP covers (non-exhaustive)
- Trade marks & service marks: words, names, phrases, stylisations, logos, icons, symbols.
- Trade dress: the overall look and feel of our products, packaging and site (e.g., size/shape, colour, textures, graphics, layout, typography).
- Copyright: product artwork, illustrations, packaging graphics, photography, marketing assets, copy, templates, and code.
- Design rights: registered and unregistered UK/EU design rights protecting product/packaging/configuration.
- Domains & social handles: MAYHAWK and confusingly similar names in domains, handles, ads and metadata.
- Patents / applications / trade secrets: where applicable, for proprietary methods and processes.
Passing off warning. Using get-up, names, or imagery that misrepresent your goods as ours (or imply our endorsement) is unlawful even without a registered trade mark.
Prohibited uses (without prior written permission)
- Company, product or service names
Do not use or register—wholly or in part—MayHawk, MAYH, MayHawk Chocolate, mayhawk, or any confusingly similar sign as (or within) a company name, trade name, product name, service name, social handle, domain or subdomain. - Logos, artwork, icons & symbols
Do not use any MayHawk logo, emblem, monogram, symbol, icon, lock-up, label, or MayHawk-owned artwork/graphics on or in connection with websites, products, packaging, ads, promotional materials, or posts. - Trade dress & look/feel
Do not imitate the distinctive appearance of MayHawk packaging, product forms, artwork, typography/lettering, colourways, layouts, or site design. Do not create designs that are likely to cause confusion, association, or dilution. - Slogans & taglines
Do not use or imitate MayHawk slogans or taglines, including:
- “Beautiful Chocolate, by Design.”
- “Chocolate made with the Earth and People in mind.”
- Endorsement / affiliation
Do not use MayHawk IP in a way that implies sponsorship, partnership, endorsement, approval, or affiliation. - Disparagement / tarnishment
Do not use MayHawk marks, logos, product images, packaging, or copyrights in a disparaging, obscene, defamatory or misleading manner. - Domains, ads & metadata
Do not register domains/subdomains incorporating MayHawk marks or confusingly similar variations. Do not bid on MayHawk marks as keywords or use them in ad copy, alt text, metatags, or hidden text to divert traffic.
Fair & nominative use. You may refer to MayHawk in a purely descriptive, nominative manner (e.g., honest reviews or news) provided there is no logo use, no stylisation, no confusion, and a clear statement that you are not affiliated with MayHawk.
Use by authorised partners
Only authorised resellers and licensees may use MayHawk trade marks, logos, artwork, and brand assets—strictly in accordance with their signed agreement and any Brand/Asset Guidelines we provide. Use must be accurate, brand-safe, and accompanied by the required attributions and symbols.

Product and packaging designs may be protected by UK/EU registered and unregistered design rights. We reserve all rights to assert and enforce these protections globally.

Certain innovations may be protected by patent applications or other rights. Where granted patents apply, we will identify them (or a virtual patent marking page) on relevant products or packaging. We reserve the right to file and enforce patents covering proprietary processes and methods, including those not yet disclosed to the public.
Genuine products
Only purchases from mayhawk.com, business.mayhawk.com, or authorised resellers are guaranteed genuine. We will take action against counterfeit products and their sellers.
Reporting infringement (notice & takedown)
If you believe MayHawk IP is being infringed or counterfeited, please contact us with:
- Your full name and contact details.
- A description of the infringing material/activity and why it infringes.
- URLs, listings, images, purchase links, or screenshots.
- The country/territory concerned and any supporting evidence of confusion or association.

Assertion and Enforcement of Rights.
Assertion of Rights.
MayHawk asserts full ownership of its intellectual property, including trademarks, trade dress, copyrights, design rights, and proprietary methods. We reserve all rights not expressly granted and will not tolerate unauthorised use, imitation, or misrepresentation of our identity, designs, or processes.
Enforcement of Rights.
We actively monitor marketplaces, social platforms, domains, advertising keywords, and packaging. Where infringement is found, we will pursue remedies to the fullest extent permitted by law — including injunctive relief, delivery up and destruction orders, damages or an account of profits, and recovery of legal costs — against counterfeiters and infringers, including for passing off and unfair competition.
